I have
friends who run an Italian bakery. What do you recommend I tell them if
they dont want to bake gay wedding cakes and yet want to
avoid being charged with discrimination?
ave you ever seen a sign on stores
near a beach that says, Service will be denied to customers not wearing
shoes? The point of such signs is to give clear advance warning that
anyone meeting the conditions specified will be refused service. It doesnt
matter if a person is male or female, heterosexual or homosexual, tall or short or
anything else; if the person is not wearing shoes, service is denied. Period. And
there is no discrimination in the affair.
Discrimination
Discrimination occurs when a specific
group is singled out for unique treatment. Consequently, discrimination can be avoided
if a bakerys policies apply to all groups across the board.
Its a sad thing, but Christian
bakeries that have gotten themselves into trouble with civil authority for refusing
to make wedding cakes for gay marriages have only themselves to blame.
And the reason is simple. Instead of having a posted policy in place, the bakeries
have presumed to tell an individual customer that service will be denied because of the
bakerys objection to gay marriage. Because that action singles out
a specific group, its discriminatory.
The Shrewd Solution
Christ told us to be as gentle as doves
and as shrewd as serpents. Well, for a bakery to avoid the sin of
condoning sin, it needs to have a shrewd policy posted
that applies to anyone. Consider, then, the following.
NOTICE
We reserve
the right to refuse any order that we deem to be obscene.
Obscenity will
be considered to be anything that contradicts the will of God,
as defined in the Bible or in the Catechism of the Catholic Church.

Consequently, with this notice in place,
an order for a gay wedding cake would have to be considered obscene
according to the posted definition, and so the order could be declined without
discrimination, just as an order for a pornographic cake from any person, heterosexual
or homosexual, could be declined without discrimination.
